Child pornography charges dropped, but prosecution says it isn't over

11-6-2013 New Hampshire:

Child pornography charges against Edward Domaingue, a retired editor of the New Hampshire Union Leader, have been dropped just three weeks before his scheduled trial.

However, County Attorney Robin Gordon said the “charges will be brought back.”

Domaingue, 65, a Florida resident with a summer home in Wakefield, was arrested on one child pornography possession charge in March. In May, a grand jury indicted him on eight felony counts of child pornography.

According to Gordon, the charges were nolle prossed — meaning they will not be prosecuted — because the county attorney's office needed to further investigate the case, and had run out of time before the deadline for the trial.

“We want to make sure we have everything we could have,” she said on Wednesday.

Gordon said after further investigation by the county attorney's office, charges against Domaingue will be brought back before a grand jury for re-indictment. She said that because the grand jury only meets once every six weeks, it might not be until 2014 that his case is considered again for indictment.

Domaingue, in a written statement released Wednesday, said his legal battle since his arrest “has been nothing short of devastating.”

His defense attorney, David Ruoff, said Wednesday, “I just hope if they have any evidence that ... exonerates him that it gets presented to the grand jury as well.” ..Continued.. by Liz Markhlevskaya
