A Portland police officer went to the Vancouver apartment of his estranged wife and allegedly pointed a gun at her new boyfriend and threatened to kill him, according to court documents.
James Botaitis, 38, of Yacolt made his first appearance Tuesday morning in Clark County Superior Court on suspicion of second-degree assault, first-degree burglary and felony harassment.
Judge Scott Collier set bail at $100,000 and scheduled an arraignment hearing for Friday.
Defense attorney Tom Phelan said Botaitis, a 10-year veteran police officer, planned to post bond.
Botaitis was arrested 6 p.m. Monday by Vancouver police officers following a domestic disturbance at his wife’s apartment in the 900 block of Southeast 136th Avenue.
The couple are in the process of divorcing, according to court documents.
According to court documents, Botaitis first knocked on the door. After his wife, Danielle Botaitis, answered, the defendant asked if someone else was there. She told him it was none of his business. Then, James Botaitis allegedly barged into her apartment with a pistol and went to the bedroom, finding her new boyfriend there.
“James comes to the closed master bathroom door and tells (his wife) that he will shoot and kill him in the bathroom,” according to a probable cause affidavit filed with the court.
That’s when Botaitis ordered the new boyfriend from the bathroom and to get on the ground. He allegedly pointed the pistol at him. The boyfriend complied.
“David Bacus (the new boyfriend) fears for his life and that he will be shot by James,” according to the affidavit.
Then, the defendant put the pistol back in his holster, talked with his wife and left the apartment, according to court documents.
Public records show that Bacus is a Level 2 sex offender. He was convicted in Clark County in 1999 of first-degree rape of a child and sentenced to 8½ years in prison. He reportedly raped a minor family member over seven years, starting when she was 5.
The pistol believed used in the incident was confiscated, Deputy Prosecutor Mike Dodds told the judge. Should he be released from jail, Botaitis was ordered to not have any firearms.
Phelan told the judge that Botaitis has no other guns at home; his work-issued firearm is in a locker at the Portland Police Bureau.
Portland police Lt. Robert King said Botaitis will be placed on paid administrative leave and will surrender his police-related powers as the investigation is under way.
According to court documents, the couple’s divorce is nearly finalized. They have a 7-year-old son; he lives with James Botaitis during the week and with his mother on weekends. Murrieta children threatened in 'manifesto' by man claiming to be sex offender

Police were posted outside a Murrieta elementary school and nearby streets Thursday after numerous residents were mailed anonymous, ranting eight-page letters that included death threats against their children.
The letters, which began arriving Wednesday and apparently also were sent to registered sex offenders, urge sex offenders to terrorize Murrieta's Hillsboro Circle neighborhood and Tovashal Elementary School, and suggest specific ways to murder local children.
The letter writer claims to be a registered sex offender disgruntled over the profusion of laws restricting the lives of "ex-sex offenders" and the "harassment" they receive. He writes that he is targeting Hillsboro Circle and the school a couple of blocks away because a group of residents launched a strident effort earlier this year to run a registered sex offender out of the neighborhood.
Murrieta police Lt. Dennis Vrooman referred to the letter as a "terrorist manifesto."
"We're taking this very seriously based upon the specifics in the letter," Vrooman said.
A copy of the letter was provided to The Press-Enterprise by one of the neighbors who received it.
"They seem to think that antagonizing us to the breaking point is somehow making children safer," the letter states. "It's time we show them they're not safer ... we should kill as many children as we can. You don't need a gun either. Just walk up to a group of small children on their way to or from school and stab as many as you can."
It also suggests planting razor blades in sandboxes, firebombing residents' homes and other violent acts.
In addition to the neighborhood residents, the writer claims to have sent the letter to all of the registered sex offenders in the Murrieta area and some others. And he lists what he claims are the home addresses and other personal details about the radio talk show personalities John Kobylt and Kenneth Chiampou, of KFI's "The John and Ken Show," who frequently use their program as a platform to rail against sex offenders.
A message left with the radio station Thursday was not returned.
After a registered sex offender moved into a home on Hillsboro Circle earlier this year, some neighbors staged angry protests in the street and posted signs with the sex offender's name and photograph. They also raised their concerns at a City Council meeting and called the Police Department. Robert Bean, a protest organizer specifically named in the anonymous letter, went on "The John and Ken Show" to talk about the effort.
Bean did not return a phone message Thursday.
Vrooman said that extra officers will be deployed at the school today -- the last day of the school year -- and in the coming days on Hillsboro Circle.
Police also have enlisted the help of regional and federal law enforcement agencies to assist with the investigation.
Officers went door to door Thursday afternoon on Hillsboro Circle -- a quiet cul-de-sac with about 30 newer tract homes -- collecting the letters from residents and confiscating them as evidence in individual brown paper bags. The letters arrived in white legal-sized envelopes and were written, single-spaced, on white computer paper.
Children rode bicycles and skateboards in the street while parents gathered in their driveways talking about the unfolding investigation.
Brian Brase, the 29-year-old registered sex offender whose presence touched off the protests, moved out of the neighborhood weeks ago.
Brase declined to comment for this story. But Roger Wallace, a friend and the owner of the home where Brase had been staying, said he now lives in San Bernardino County.
Brase left not because of the protests but to be closer to his new job as a chef, Wallace said.
Wallace said Brase, too, received a copy of the letter and was very upset by it.
"This guy is a psycho," Wallace said of the letter writer. "I hope they catch the guy, because this guy is trying to incite terrorism in the neighborhood."
Some parents who live on the cul-de-sac said they disapproved of the protests outside Brase's home. Now, they said, they are beside themselves with worry over their children's safety and angry at the neighbors who spoke out against the sex offender.
Retrieving a small package from her mailbox Thursday, Christine Morphew scrutinized the address before cautiously lifting the lid.
"This is how paranoid I am," she said with a nervous laugh. "It's just dog shampoo!"
"This has just been a nightmare," said Starla Church, another parent.
Church said she was so embarrassed by the mob mentality of some of her neighbors that she apologized to Brase in person.
"He was doing his own thing. He wasn't bothering anybody," Church said.
Church said her 10-year-old son couldn't sleep after they received the letter Wednesday, and Thursday he was afraid to go to school.
"It's a good neighborhood. I loved it when I moved in," Church said. "Now we don't know when we'll breathe easy again." ..Source.. Sarah Burge

Threats against parole agent in Jaycee Dugard case prompt move

ANTIOCH — The parole agent who supervised kidnapping and rape suspect Phillip Garrido has been moved to a different location because of threats against him and his family, the state corrections department said today.
California Department of Corrections and Rehabilitation Spokesman Gordon Hinkle said the agent and his family were moved shortly after Jaycee Dugard was discovered and Garrido and his wife, Nancy, were arrested Aug. 26.
The move was "due to security concerns that the department had," Hinkle said.
Hinkle said the agent's name leaked to the public, prompting the transfer. Hinkle would not say where the agent was transferred.
His children had to be taken out of school because of threats.
"He had received serious threats to his personal safety," Hinkle said. "There were threats of several kinds, but I can't divulge ... the details."
The Garridos have pleaded not guilty to abducting then 11-year-old Dugard outside her South Lake Tahoe home in 1991 and holding her captive in the backyard of their Antioch home for nearly two decades.
Phillip Garrido was a registered sex offender on federal parole for kidnapping and rape. The agent who was moved was the latest in a series of parole officers who supervised him. ..Source.. Roman Gokhman

CA- Elementary school students suspended for kill list and sexual threats
Clearly the sexual issues are the result of all the political hate speeches about former now registered sex offenders, and real sex offenders who are committing crimes today. This is what political speeches are teaching to today's youth (esp. children of RSOs who not only hear it but also live it). Hate speech about RSOs, while not protected under Hate Crimes laws still has its effects on society, here we see today's youth using it at a very young age. No matter how you view this, it is a NEW form of "second generation" retaliation / revenge for what they are suffering daily. What goes around comes around...

A group of parents allege Santa Margarita Elementary School officials have failed to provide a safe environment and have chosen to keep their children home until their concerns are addressed.
After numerous complaints, two Santa Margarita Elementary students have been suspended in the past few weeks for threats against other students. A fourth grader was sent home for producing a hit list and a third grader was suspended for making sexually violent threats against his classmates.
CalCoastNews has chosen to leave out the names of the parents and the students involved in the incidents in order to protect the children’s privacy.
More than a handful of parents said their children have been traumatized by a series of incidents that began on May 13. Parents described a student’s graphic sexual threats against other students in his classroom.
Officials and parents claim Principal Melanie Karp has been slow to respond to complaints made by parents and students and has minimized the situation.
School officials are mandated reporters and as such are required by law to report these types of criminal threats and certain suspicions of child abuse immediately, and follow up within 48 hours with a written report, said Child Protective Services Social Worker Desilyn King.
“This all needs to be dealt with for the best interests of all, not just my child,” a parent said voicing her concern for the safety of the aggressor as well as her progeny. “My child hasn’t wanted to go to school.”
Several parents have opted to keep their children home until school officials can assure them their children are being protected. Parents allege Karp has threatened to turn them in for truancy if their children do not return to school.
“Our first and foremost goal is the safety of our students,” said Atascadero Unified School District Superintendent John Rogers. “It is awful to deal with providing the appropriate resources to help the individual student and balance the need for other parents to be assured their child’s safety is foremost.”
Principal Karp was unavailable for comment.
On May 13, the third-grade aggressor was suspended for three days and sent home to a parent who is on the Megan’s Law sex offenders list. Upon his return, he blamed a student for a beating he claims to have received as punishment for the suspension, sources said.
An attempt to find out if a report regarding the alleged beating was filed with Child Protective Services was denied due to privacy issues.
He then threatened to shove items into the complaining students’ rectums and/or vaginas. As a result, Karp assigned the child to a half day in-office suspension before placing him back in the classroom. Due to parent complaints, on May 20, the boy was moved to another classroom comprised of second and third graders.
Parents also voiced concerns that the child’s mother, a registered sex offender known to commit lewd acts against children under 14 years of age, is permitted to attend school functions.
“They recently put a black metal fence around the perimeter of the school to protect our children,” a parent said. “Then they let a sex offender in the front door.”
There is a common misconception that laws prohibit registered sex offenders from encroaching on school grounds. However, according to California code, sex offenders may be allowed on their child’s campus for a variety of reasons. In addition, not all sex offenders are listed on Megan’s list which is primarily for habitual or violent offenders, said a San Luis Obispo County Sheriff deputy.
While at Santa Margarita Elementary School, the boy’s mother is required to register and is then provided an escort while on school grounds, Rogers said.
In addition, on Thursday May 14, school officials discovered a fourth grader’s kill list along with a visual depiction of a student’s demise. Five days elapsed before the mandatory threat assessment protocol was implemented, sources said.
Following parent objections to a lack of concern over the hit list, on May 19, sheriff deputies were called to the school and the boy’s home was searched, sources added.
The child remained in the classroom, shoulder to shoulder with children on his kill list, until he was officially suspended on May 20.
The district has adopted a threat assessment protocol, a flow chart to be implemented by the principal. During the week following the threat, four psychologists did an evaluation to determine if the written warning was a transient or a true threat, Rogers added.
“I can’t comment on what we have done with any one student,” Rogers replied when asked what actions had been taken.
Last year, Karp was sentenced to two days in county jail for driving under the influence. Her blood alcohol was .12, one and a half times the legal limit. She is slated to retire at the end of this school year. ..News Source.. by KAREN VELIE

UK- Court told of child sex offender’s threats to victim

A CHILD sex offender who made venomous, hate-filled threats against the 13-year-old girl he sexually assaulted has been jailed for four years.
Persistent Paul Vincent Jones, 27, touched the teenager’s body as she resisted his advances and asked, “Can’t you leave me alone?”
He made lurid threats against the girl to a probation officer after he was reported to the police and bailed, Teesside Crown Court heard. The officer was worried for his own safety as Jones became agitated and aggressive in a meeting concerning his mental health on January 25.
Smith said he was “stressed out” over the court case then became abusive, insulting and derogatory about the girl. “He said he was going to string her up. This shocked the probation officer,” said prosecutor Paul Cleasby yesterday.
The officer tried to calm him down but he launched a tirade saying: “Listen mate, I’m going to kill her, murder her, knife her. I know where she lives.”
Mr Cleasby said the probation officer was concerned about the level of “venom” and hatred from Jones, and worried that Jones could confront and hurt her.
Jones, of Zetland Road, Stockton, denied sexual activity with a child but was convicted by a jury after a trial in April. He still denies this crime, which took place last year. He admitted threats to kill.
When he was 16, he was cautioned for indecently assaulting a teenage girl on her way home from school.
Jonathan Walker, mitigating, said the recent sexual offence was “an opportunistic moment of stupidity” and the threats were never meant to be conveyed to the complainant.
“He is prone to outbursts. That’s his modus operandi. He thinks very little of the implications of his acts.
“He is full of hot air, full of bluff, however violent and full of venom, he has no control over his use of words. He never carried out any such acts, never approached the complainant, never sent her abusive letters.”
Mr Walker said Jones arranged the appointment with the probation officer because he was concerned about his mental health.
He added Jones, interrupting the prosecutor from the dock saying “What’s it got to do with you,” still could not manage his own “volume control”.
In prison Jones, a self-confessed drug dependant using cannabis and amphetamines, did courses on drugs misuse and anger management.
The judge, Recorder Paul Reid, jailed Jones for three years for the sexual offences, plus one year for the threats. He also gave Jones a seven-year sexual offences prevention order and an indefinite ban from working with children.

WA- Thompson to lawyer: 'You're going to be dead'

SEATTLE -- On the second day of his trial, Curtis Thompson, a level-three sex offender who has already served 18 years for raping four women in 1985, had some words he couldn't wait to say.
Before witnesses testified, and even before the judge had a chance to call in the jury, Thompson, who is charged with ten crimes in connection to the incident, declared he had already begun preparing an appeal.
"Since I'm denied a fair trial in this tribunal, I'm preparing the appellate process," he said.
Prosecutors say in August 2004, Thompson robbed and assaulted two women and beat up an elderly man who tried to intervene at a University District apartment.
In court on Thursday, the prosecutor used diagrams to help witnesses recreate the night of the attack. He also played a tape of the 911 call that alerted police.
Thompson chased the women into the apartment's elevator and tried to sexually assault them, forcing one of the women to take off her blouse, prosecutors said.
"He forced them in, grabbed their bag, and then pushed them in the elevator. We think that two of our girlfriends are in trouble." a 911 caller was heard saying.
That 911 caller took the witness stand and described seeing the victim running from the elevator in tears, without her blouse.
"She was pretty hysterical. She looked like she'd been crying. She didn't have her shirt on," said witness Jennifer Tonumalepea.
Thompson has been stirring up trouble ever since his trial began on Wednesday when he lashed out at the prosecutor, calling him a "liar" and a "punk," and refusing to calm down even as the judge tried to recess the court.
As Thompson was being led out of the courtroom on Thursday, he stared at his own attorney and said, "You're going to be dead." He then let out a profanity-laced rant.
The convicted rapist, who is notorious for resisting the hand of the law, gets strapped to a chair before being brought into, or taken out of the courtroom.
The trial will resume on Monday.
Thompson has two other trials coming up. In November trial begins for his alleged rape of an Eastlake woman in her apartment. The trial for his alleged murder of a disabled woman is slated to begin next year. ..News Source.. by KOMO Staff
