Pinellas County Sheriff's Office to stop posting online mug shots

LARGO — Mug shots of inmates at the Pinellas County Jail will no longer be posted on the Pinellas County Sheriff's Office website starting Monday.

Since 2005, the Sheriff's Office has allowed public access to mug shots, which are photographs of inmates who are booked into the jail.

But Sheriff Bob Gualtieri announced Thursday that his office will stop posting the photos online because commercial websites continue to scrape mug shots from his office's "Who's In Jail" web page. Other websites then repost them, and some charge fees if people want their mug shots removed.

"The reposting of their booking photo isn't illegal," Gualtieri said, but added that charging a fee is "unconscionable, verging on blackmail and clearly taking advantage of someone's circumstances."

Last year, mugshots.com advertised removal packages ranging from $399 for removal of one arrest to up to $1,799 for five. But on Thursday, removal costs were not available on the site. Mugshots.com operators could not be reached for comment. Because websites may charge different fees, "a person may have to pay an exorbitant amount of money" to remove each post, the sheriff added.

People searching the "Who's in Jail" site will still be able to access information, such as an inmate's name, charge and date of birth, but photos won't be available online. However, public records requests will be honored, the Sheriff's Office said.

About 50,000 people are booked into the Pinellas County Jail every year. A Florida Sheriff's Association spokeswoman said Thursday that the organization had not heard of any other sheriff's agencies considering removing all booking photos.

Other sheriff's offices in Tampa Bay have not planned to follow suit, but Pasco sheriff's spokesman Kevin Doll called the Pinellas change "an interesting development."

"We would just like to see how it works for the time being," he said, adding that arrest information could still be obtained by the commercial websites, even if the photos are not available online.

But Gualtieri said residents he spoke with whose arrest records had been picked up by the websites were mostly concerned about the photos. Gualtieri's decision is among several recent efforts to deter the websites from cashing in on people's arrests.

In June, Shannon Bilotta, 44, was arrested by Largo police on a domestic battery charge and booked into the Pinellas County Jail. The next month, the charge was dropped. But Bilotta's mug shot remains online.

She is the plaintiff in a federal lawsuit against several mug shot websites, including mugshots.com and arrests.org, that was filed in November. Her attorneys are seeking class-action status.

Among them is Tampa lawyer Matthew Crist, who said Gualtieri's decision was "really good news."

"It will stop these websites from being able to acquire content, at least from the Pinellas County Sheriff's Office," he said. People "won't face the same problems that Ms. Bilotta did."

A similar lawsuit was filed in Toledo, Ohio, which resulted in a settlement last year that included an agreement with two websites, BustedMugshots.com and MugshotsOnline.com, to stop charging fees for mug shot removals.

The Tampa Bay Times also posts mugshots of arrestees on its website at tampabay.com/mugshots — but does not accept payment for removing them. All photos and booking records published at tampabay.com/mugshots are automatically removed 60 days after the booking date. ..Source.. by Laura C. Morel

QUESTION:
I just moved to a new house. Shortly after moving in, I found out that a previous tenant had been a registered sex offender with his address (now my address) listed. Although the state sex offender registry rightfully has delisted my address, it is still listed on private Internet registries who have not responded to my request to remove my address. One site, Offendex.com, even wants me to pay them 200 dollars, otherwise they will NEVER take it off! I really don't have the money for a lawyer to fight this, but I've had two windows broken and my car key-scratched, as well as get late-night honks and shouts of "pervert!" all the time, and I'm frankly scared for my family's safety. Local law enforcement is powerless to do anything. What can I do?

ANSWER:
Contact the attorney general's consumer protection office and see if they can help or point you in the right direction. It is almost extortion to make you pay to have information corrected. The sex offender's name and associated address is supposed to be the information supplied to the public not an address. You may have an injury suit and if a personal injury attorney took the case, they work for a percentage of anything collected, not an upfront fee. ..Source.. By LawGuru

Publisher arrested on suspicion of extorting sex offender’s family

10-28-2011 California:

The publisher of an Irvine-based Persian magazine has been arrested on suspicion of attempting to extort money from the family of an Orange County rug merchant accused of assaulting 11 women.

Javad Mostafavi, 70, was arrested last week on suspicion of extorting from the family of Saeid Boustanabadi Maralan, who is being held on $1.5 million bail in connection with the alleged assaults, police said.

Maralan's wife reported that Mostafavi threatened the family on several occasions, saying he would print Maralan's booking photo on the cover of his magazine, Payam-e-Ashena, if he wasn't paid $3,000, police said. The magazine publisher even emailed the wife a mock-up of the magazine with Maralan's photo on the cover, according to Lt. Jason Kravetz of the Long Beach Police Department.

Maralan, the manager of Sirous & Sons Rug Gallery in Laguna Beach, is a registered sex offender who has several sexual assault convictions in Los Angeles County, according to police and court records.

Several female customers reported that Maralan would lure them into the back of the store and then expose himself or attempt to fondle them or force himself onto them, police said. After initial reports of his arrest, several additional women came forward to accuse Maralan of various sexual assaults, police said.

Maralan faces a maximum sentence of 60 years to life in state prison if convicted, prosecutors said. ..Source.. by LA Times

Brooklyn man charged with extorting son of convicted sex offender

11-7-2010 New York:

A Brooklyn man who threatened to accuse the adult son of a convicted sex offender of sexually assaulting his son unless he was paid over $100,000 was charged today with attempted grand larceny, according to the Brooklyn District Attorney’s Office.

Simon Taub, 61, allegedly got the message to Meyer Lebovits that he planned to inform the Brooklyn District Attorney’s Office that Lebovits sexually abused his son.

Lebovits notified the DA’s office about the threat and an investigation began.

The investigation came to a head in July, when Lebovits forked over $75,000 to Taub. Shortly after the transaction, Taub was arrested.

Lebovits, 31, the son of Baruch Lebovits, who is serving a 32-year prison sentence for sexually abusing a Borough Park teen, declined to comment Friday when reached on his cell phone.

His lawyer, Arthur Aidala, refused to discuss the case.

If convicted, Taub faces up to seven years in prison.

Taub has made headlines before. He and his wife, Chana, divided their Borough Park home with a wall as they went through a bitter divorce. ..Source.. EDMUND DeMARCHE

Port St. Lucie woman guilty of extortion of convicted sex offender

6-25-2010 Florida:

FORT PIERCE — A jury took just 19 minutes Wednesday afternoon to find a 47-year-old Port St. Lucie woman guilty of trying to extort $33,000 and a 2003 Cadillac DeVille from a convicted sex offender.

Carol Merrilee Wands faces up to 15 years in prison when she is sentenced July 28 for the second-degree felony conviction.

In the one-day trial John Deshler, 41, who pleaded no contest in 2005 to a charge of lewd or lascivious battery for inappropriately touching a girl in her mid-teens and was sentenced to 15 years of sex offender probation, testified he had a lunch date with Wands, a co-worker, in June 2009 and that and afterward the two kissed and fondled each other at her house in the 400 block of Southeast Sandia Drive.

Deshler admitted he was “turned on,” but testified that when Wands said, “I don’t know if we should do this,” he backed off.

About a week later, he said, he received a letter from Wands through their boss demanding 33 payments of $1,000 in cash and provide the title to his Cadillac or she would report to his probation officer that Deshler force himself on her.

Deshler said he took the threat seriously because “all it takes is an allegation, and I’m done; I’m back in prison. … I’m assumed to be guilty and have to prove I’m innocent before I get out.”

On advice from an attorney, Deshler contacted the State Attorney’s Office and worked with investigators to record phone conversations with Wands and videotape, with a camera hidden in Deshler’s watch, an initial transaction July 27 of $1,000 and the car’s title.

Jurors saw the tape, which ends with police surrounding the car and arresting Wands, on Wednesday.

“That the jury came back with that verdict in that short a time suggest to me that they were convinced of their decision,” said Assistant State Attorney John Cannizzaro. “I think it also shows that anyone can be a victim of a crime, even a convicted sex offender.”

Both Wands and Deshler now have been convicted of second-degree felonies. Deshler took a plea deal and received a probationary sentence; Cannizzaro said he’ll ask Circuit Judge Lawrence Mirman to incarcerate Wands. ..Source.. TCPalm.com
