A judge has ruled that a registered sex offender wasn’t under arrest during a police interview that resulted in criminal charges, and wasn’t owed an explanation of his rights.
Outagamie County Judge Michael Gage ruled this week that statements made by Christopher R. Lucksted last year will be allowed as evidence when he goes on trial. Lucksted, 43, of Winneconne, is charged with exposing his genitals to a child and attempted exposure.
“Lucksted was told many times that he was not under arrest, that he did not have to talk with the officers and that he ‘could leave whenever,’” Gage wrote in his decision.
Lucksted is accused of exposing himself and making inappropriate advances to teenage girls. He asked Gage to dismiss his statements — and any evidence derived from them — because he didn’t receive a Miranda warning.
He is scheduled to appear for a two-day trial beginning May 21. ..Source..
