A local homeless man has admitted he broke into a sex offender’s Bay City apartment, though he likely serve less than two years in prison.
Michael C. Comtois Jr., 23, this month appeared in Bay County Circuit Court and pleaded guilty to one count of second-degree home invasion, a 15-year felony. In exchange for his plea, prosecutors agreed to dismiss a count of larceny in a building and to not seek a habitual offender sentencing enhancement.
Prosecutors also agreed to recommend Comtois’ sentence not exceed 23 months in prison, court records show.
Sometime between July 3 and July 31, Comtois broke into the apartment of an acquaintance. The resident, who must register as a sex offender for the rest of his life, was in jail in Sanilac County in that span, court records show.
Upon returning home, the resident called police to report a 32-inch Samsung flat-screen TV, toiletries, food and bedding were missing. The man told police he believed Comtois, whom he had allowed to sleep over at times, was the guilty party.
In the course of their investigation, police visited the home of a relative of Comtois and located the stolen Samsung, court records show.
At the time of the burglary, Comtois was on probation in Isabella County on a charge of third-degree home invasion. He previously served probation terms in Isabella and Midland counties on charges of third-degree home invasion and attempted larceny in a building.
Circuit Judge Harry P. Gill is to sentence Comtois at 8:30 a.m. on Monday, Nov. 19. ..Source.. by mLive.com
