Board of Barber Examiners Adopts Registered Sex Offender Policy

Subject: Board policy regarding applicants and licensees on the North Carolina Sex Offender Registry

References: North Carolina General Statutes. 86A-18(1), 21 NCAC 06Q.0103 and Article 27A of Chapter 14, North Carolina General Statutes.

1. Purpose: The purpose of this policy is to establish procedures for determining an applicant’s or licensee’s fitness for licneusre while registered as a sex offender per Article 27A of Chapter 14, North Carolina General Statutes.
a) The Board will not approve any application for a student permit, initial apprentice barber, registered barber or barber school instructor licenses or any license renewal for an individual whose name currently appears on the North Carolina Sex Offender Registry.

b) The Board will conduct administrative hearings for all current licensees whose names are discovered to be active on the North Carolina Sex Offender Registry. The registered sex offenders’s license(s) will be suspended until the individual is no longer listed on the North Carolina Sex Offender Registry.

c) Applicants and licensees with a criminal history of a sexual offense(s) must first petition the appropriate court to have their names removed from the North Carolina Sex Offender Registry before the Board will grant a hearing for one requesting permission to attend barber school, sit for any examination administered by the Board or for license renewal and/or reinstatement.
