Sex Offenders Banned from County Recreation Areas

Unfortunately "Area Banishments" have been the law in other areas, and upheld by their state courts: see North Carolina's "STANDLEY v. TOWN OF WOODFIN -and Indiana's "DOE v. TOWN OF PLAINFIELD, INDIANA"
4-9-2011 California:

The Orange County Board of Supervisors, on April 5 voted unanimously to adopt a new law banning registered sex offenders from county parks, harbors, beaches and playgrounds.

According to an Orange County District Attorney’s Office press release, the ordinance, developed and proposed by District Attorney Tony Rackauckas and Fourth District Supervisor Shawn Nelson, makes it a misdemeanor for registered sex offenders to enter county recreational areas where children regularly gather without permission from the OC Sheriff's Department.

"Orange County has taken a huge step in creating a safety zone for our children," said Rackauckas. "Parks, harbors and beaches belong to families and children, not registered sex offenders."

The ordinance is set to take effect Thursday, May 5. Enforcement in parks and harbors will be entrusted to the OCSD. Violators could face up to six months in jail and/or a $500 fine. ..Source.. by Andrea Swayne (Ordinance found at link)

Wondering how easy it'll be to be granted permission from the Sherrif's dept. Maybe easy, they just want to know who's there. Gotta live with junk like this, but at least there's a permission clause. acrob

I thought parks and beaches belonged to all of the public. Are Sex Offenders exempt from paying the taxes used to support and maintain these public areas? No? Is it explicitly written somewhere that a certain segment of the public owns public areas?

No Frosty, we don't have to live with this crap. It's taking away a citizen's right to make use of public facilities that his/her taxes pay for. It's illegal and unconstitutional. What happens if the RSO has children, is he or she banned from accompanying them to the park, beach, or wherever? Isn't that putting the RSO's children in danger if they are forced to go unaccompanied?

These FOLKS don't get it. Everything they do is just kneejerk reactions to events, and do nothing to protect children. Children face 10 times the danger from persons that they know and/or live in their homes than they do from strangers in public parks.

Instead of spending all this money on creating new laws to suspend my basic human rights, they should be spending it on educational programs for kids.

Profiling will happen and so will the law suits as well.I wonder how long it will be before Orange County will be flooded with court actions cases and losing them at that.The D.A. must be looking for re-election next year.
