If it is true that RSO folks must notify LE of places they "frequent (interpreted as a move by LE)" then it is mandatory to report trips to the grocery store, drug store, and other such shopping, etc. even though such would be a ridiculous interpretation of the law, it is the law. Or is it? I'd love to hear from a Nebraska RSO on this point of law...8-16-2010 Nebraska:
She cried, she pleaded, but that didn't stop the Nebraska State Patrol from handcuffing ___, 22, on suspicion of violating the state's sex offender registry law.
About 9:30 a.m. Saturday, two NSP representatives and a probation officer pulled in the driveway of a north Lincoln residence where investigators say ____ had been staying with her child for more than three days without notifying law enforcement.
___ and her toddler were playing in the front yard. Sgt. Drew Ferguson said it was the child's day-care provider's house.
"Oh, my God. Oh, my God," ___ said. "I'm so scared. I don't want to go to jail."
"You'll be fine," her friend and child's day-care provider said as she handed ___ a pair of flip-flops and agreed to take care of ___'s child.
The day-care provider held a cell phone to ___'s ear as she made a last-minute phone call.
___ then kissed her child goodbye and a police cruiser arrived to take her to the Lancaster County Sheriff's Office.
___ is a lifetime sex offender. In April 2009, a district judge sentenced her to one year of probation for having a sexual relationship with a 15-year-old boy she met when she worked at the Salvation Army.
Lancaster County has 200 lifetime offenders. On Saturday, officers knocked on 188 doors to make sure they were in compliance with the Nebraska sex offender registry law. Officers arrested six.
"Since the first of the year, there have been changes made in the way sex offenders are categorized and how they must register," Ferguson said. "Checks such as this one will help to ensure lifetime offenders are complying with those changes."
By law, sex offenders must notify law enforcement of all changes in addresses that they live at or frequent within three days.
Since January, Nebraska's new sex offender registry law also requires lifetime offenders to report in person to the county sheriff's office in the month of the offender's date of birth and every three months thereafter.
Violation of sex offender registration is considered a Class 4 felony, punishable by up to five years in prison and/or a $10,000 fine, according to the Nebraska State Patrol.
Around noon, officers made another arrest. ___, 32, was located at his residence at the Economy Lodge near the Lincoln Airport. He was arrested on suspicion of violating the sex offender registry law.
___ sat cuffed on the sidewalk until a cruiser arrived to take the two-time convicted sex offender to the Lancaster County Sheriff's Office.
The Nebraska Sex Offender Registry website said ___ was convicted of third degree sexual assault in 1998 and sexual assault of a child in 2003.
Not all lifetime sex offenders were located on Saturday. Ferguson left door hangers on the doorknobs of 41 sex offenders who were not home when officers stopped by. ..Source.. ALISSA SKELTON / Lincoln Journal Star
