Sex offender nabbed seeking computer service facing new charges

OK, let no one misconstrue my point, I do not support child porn, but study this article closely. Guy takes computer to store for repair, rather than repairing the computer, the employee spent his time SEARCHING whatever pictures were on the computer. What gives him authority to do such? Its the same as, hiring someone to clean your carpets, and they search through your personal draws looking for whatever, no difference.
7-29-2010 Massachusetts:

A Level 3 sex offender convicted of multiple child sex crimes in Michigan is set to appear before a judge today for a bail hearing on new child pornography charges in the Bay State, prosecutors said.

____, 48, of Chelsea, was charged in April with four counts of possession of child pornography after an employee at a Revere Staples found pornographic pictures of a young blond boy on the supsect’s computer, said Jake Wark, a spokesman for Suffolk County District Attorney Daniel Conley.

Wark added ___ had taken the computer to Staples to be repaired.

The employee contacted Revere police, who turned the computer over to state police for a forensic examination, Wark said. The examination also revealed links on ___’s computer to pedophilia chat rooms.

___ was released on $1,000 bail at his district court arraignment. He was indicted last week by a Suffolk County grand jury and ordered held by a clerk magistrate without bail pending today’s hearing, Wark said. He has pleaded not guilty.

___’s Sex Offender Registry Board online flier indicates he was convicted of indecent assault and battery on a child under 14 in 1991 and convicted of assault with intent to rape in 1992.

In 1993, ___ was convicted of two counts of indecent assault and battery on a child under 14, the online record shows.

He is represented by attorney David Burgess. The bail hearing is scheduled to take place at 2 p.m. in Suffolk Superior Court. ..Source.. Laura Crimaldi

Actually, I see no problem with the chain of events as documented in the article. Yes, if it went down the way you describe it I agree 100%, it seems like unauthorized search. However, reading the account here, it says the tech discovered links to a pedophilia site. Now, if he was having issues, most likely he had got one or more computer viruses and those tracks would appear in the history and would be normal that someone in his capacity would find them.

I agree with Joe on this one. When somebody drops off a computer for repair ("It's running slow, I think it has a virus.") the first thing a tech is going to do is search for viruses and spyware. Porn sites leave lots of spyware and viruses and garden-variety cookies. It isn't a case of the tech spying on someone.
A fellow technician friend of mine was in a similar situation - a guy brought his computer in complaining of freeze-ups and such. A co-worker noted on the work log that it "might have illegal files." It was child porn. They had to call police, because to do anything less could leave the whole shop open to prosecution. If you find a smoking gun, you have to call police.

I'm no techie, but I have heard of Spam being delivered that contains illegal images, and the owner of the computer never knows it exists. (Ga FBI and Spam pornography warning is an article I have in one of my news article files.)
ALSO, is there also a possibility that someone else used the computer? Did he buy this used?
