Study his actual actions then decide if this is a sex offense? Just his actions not what may have come next.. The article says "he stopped," equate this to a fellow taking a girl's hand and kissing it; is that a sex offense, if so, then all foreplay (or whatever you want to call actions, including taking a person out, where does that line end?)must be considered sex offenses. Right?
10-16-2009 Ohio:
MILLERSBURG -- A Holmesville man described by a judge as "a sex offender with some serious psychological issues" will be required to display a sign at his residence.
___, 28, ___________, was sentenced on one count of gross sexual imposition Thursday by Holmes County Common Pleas Judge Thomas D. White to 120 days in jail, mandatory sex offender counseling and five years probation. Through the term of his probation, ___ will be required to post a sign at his residence that identifies him as a sex offender.
The charge against ___ stems from a Feb. 17 incident, when, according to court records, he invited a woman to his home on a business call to discuss insurance. While he and the woman were speaking, ___ grabbed and stroked her foot. When she began to resist, ___ picked her up and started to carry her to a bedroom.
___ said to adult probation authorities conducting a presentence investigation that while he was carrying the woman, he realized he was in a position to rape her. He said he then put her down.
Andrew Hyde, ___'s attorney, described ___'s actions as those of a socially inept and lonely man.
"(There is) a lack of intimacy in his life," Hyde said. "He doesn't know how to act around women. He's getting older, he's getting lonelier."
___ acted the way he did because he believed "he was enticing her," Hyde said.
Holmes County Prosecuting Attorney Steve Knowling, however, said the presentence report showed ___ is wavering between a dangerous line of fantasy and reality. ___ admitted he grabbed the woman's foot for sexual gratification and believed the woman was responding to his advances, according to the report. After the woman left his residence, ___ tried to contact her via cell phone for another meeting, Knowling said.
"(___) misconceptualised that what he did wasn't wrong," Knowling said. "This is an individual who is starting to leave his fantasy world and he's bringing other people into it."
White said he considered prison for ___, but felt he should get counseling.
"With prison, he's not going to get treatment, he's going to get out and things aren't any different in his head," White said.
White ordered ___ to pay a $1,000 fine. The gross sexual imposition carries a mandatory classification for ____ as a tier 1 sex offender. ..Source.. by NICK SABO
