KS- Kearney man gets 18-year sentence for molesting 6-year-old girl

There are some who do not belong in society, his comment will ultimately lead him to civil commitment.

A Kearney man who told authorities that a 6-year-old girl he was accused of sexually assaulting was “built like she is 13” was sentenced Friday to 18 years in prison.

Mark Schmollinger, 55, pleaded guilty in Clay County Circuit Court to first-degree statutory sodomy stemming from an incident involving a child on Aug. 15, 2008.

Clay County Prosecutor Daniel L. White said in a news release that the victim went to Schmollinger’s residence to get a bandage for a bug bite on her knee. The girl asked to use the bathroom and was then sexually assaulted by Schmollinger, White said.

In a statement to police, White said, Schmollinger told investigators he had victimized the child. When asked by authorities how old he thought the victim was, Schmollinger told police, “I would say 7, but she is built like she is 13.”

The victim was actually 6, White said.

“That made for some raised eyebrows,” said White. “I’m sure he meant for that comment to mitigate his bad acts. It didn’t.” ..Source.. by Glenn E. Rice
