The question here is, did the day care open AFTER he began living at his address, or BEFORE he moved into his residence? Or, is his conviction a "new conviction" causing the violation?

A convicted sex offender was placed under arrest Wednesday for disregarding state law and establishing his residence too close to a daycare center.
Donald Lavermon Beason, age 47, was arrested at his 600 North Military Avenue home shortly after 11:00 a.m. Wednesday on charges of violating the state sex offender registry law and residing too close to the Lawrence County Child Care Center, located at 124 Brink Street.
State law prohibits any convicted sex offender from residing “within one thousand feet of the property line of any public school, private or parochial school, licensed day care center, other child care facility, public park, playground, recreation center or public athletic field available for use by the general public.”
According to arrest reports Beason had previously been issued a warning, informing him that he was required to move from the residence. Officers indicate, however, that Beason “refused to vacate the residence.” Beason was located at the residence on Wednesday prior to his arrest.
Beason is slated to answer the charge through Lawrence County General Sessions Court on Friday, November 7, 2008.
Under state law a first violation of is punishable by “a fine of not less than $350 and imprisonment of not less than ninety days.” Second offense penalties include a $600 fine and imprisonment of 180 days. Third and subsequent offenses are punishable by a fine of $1,000 and imprisonment of not less than one year. ..News Source.. by Lawrence Berg Now.com
