6-3-2008 Kentucky:
The Kentucky State Police has appealed a state attorney general’s office ruling that KSP violated the state’s open records act by not providing The Courier-Journal with a copy of the state’s online sex offender database.
The April 17 ruling said the records were available, had been provided before and would not be a burden to the state police to provide again.
But in an appeal filed in Franklin Circuit Court last month, the state police say the records are not kept in the format the newspaper has requested and they should not have to generate the records.
And, the state police argue that the records had been provided before “one time in an effort to assist” with a story. The state police determined “it was not possible to continue extracting data from the registry to provide these records to the public.”
The state police have also argued that the records are available already on their Web site, which The Courier-Journal could provide a link to. ..News Source.. by The Courier-Journal
