ID- Young Girl Not Charged for Topless Text

NOT THIS TIME! WOW, these kids are lucky because under the Adam Walsh Act, if charged, they could have spent up to 10 years in federal prison and be subjected to civil commitment proceedings.

6-6-2008 Idaho:

A half a dozen pre teens will sleep a little easier, knowing they won't be labeled sex offenders after sending around a picture of a topless student on their cell phones.

Local News 8 first told you about the investigation into a rocky mountain middle school student a couple weeks ago.

A young girl approached the principal claiming her boyfriend was sending around a topless picture with her head pasted on top.

It turned out, the young girl actually took the topless photo herself, which ended up on the cell phones of several students.

Bonneville County Prosecutor Dane Watkins says kids their age don't always realize the repercussions and the dangers of their actions.

"Once it's released, as these children have learned, you can never bring it back. And you don't know where it's going to end up. It could be on someone's myspace page and then picked up by individuals who have other interests with children," Watkins said.

Watkins also says there are no laws dealing specifically with cell phone pornography on the Idaho books, but child pornography charges could have applied in this instance.

You should talk to your children about the dangers of taking or sending inappropriate pictures over the phone.
