DES MOINES (AP) - The Iowa Supreme Court has rejected a challenge to a state law that prohibits convicted sex offenders from living within 2,000 feet of a school or day care.
Floyd Wright was convicted in Polk County 1977. He never registered as a sex offender because his conviction happened nearly 20 years before the law took effect.
Wright was on probation for driving while barred when he was recently forced to move from Des Moines. His probation officer told him because he was a convicted sex offender he was prohibited from moving to his new home, which was within 2,000 feet of a protected facility.
Wright challenged the law, claiming it applied only to registered sex offenders, and didn't apply to him.
A district court disagreed, saying the law applied to all sex offenders, not just those on the state's registry. The Supreme Court agrees, saying the Legislature didn't limit the law just to those on the list. ..more.. by KCRG TV
