Five years for a failure to register offense, thats absurd. FTR is an administrative type offense, victimless, and the U.S. Sup court (Weems v U.S.) has held such punishment for an administrative type crime is excessive and unconstitutional; so it is actionable!3-19-2013 Oklahoma:
Convicted sex offenders who fail to register with law enforcement would face a minimum of five years in prison under a bill approved by a House committee over the objections of opponents who say it will only make state prison overcrowding worse.
The House Judiciary Committee on Tuesday voted 10-3 for the bill by Republican Rep. Leslie Osborn of Mustang. The bill already has passed the Senate and now heads to the full House for consideration.

Judges currently can sentence offenders to a maximum of five years in prison for failing to register, but Osborn says most receive 90 days and are released with electronic monitoring.
