QUESTION:
It is illegal to have phone or cyber sex with another adult having to do with fantasies about minors? Or, it is only illegal to entice minors online, or to download and trade illegal pornography?
LAWYER'S ANSWER:
If you are having child molestation fantasies, acting on them or communicating them to others in any manner is very likely to get you locked up forever, or for a long time, followed by your having to register as a sex offender. Assume anyone you meet online is a police officer.

Is Rudolph Male Or Female?
12-22-2008 North Pole:
Wildlife Expert Ponders Question Of Reindeer Gender
There may be a perfectly good reason why Santa doesn't get lost on his annual Christmas globetrot: His fictional flying reindeer just might be females who don't mind stopping for directions.
The gender of Rudolph and his/her sleigh-hauling friends - the subject of goofy Internet chatter every year about this time - is now being pondered by even the renowned wildlife experts at Texas A&M University.
"Santa's reindeers were really females, most likely," said Dr. Alice Blue-McLendon, a veterinary medicine professor specializing in deer who cites the depictions of Santa's helpers with antlers as the primary evidence. It turns out real reindeer grow antlers regardless of gender, and most bulls typically shed their fuzzy protrusions before Christmas.
What's more, if Santa really has reindeer and they really are female, they might even be be hauling around tons of toys while pregnant, said Greg Finstad, who manages the Reindeer Research Program at the University of Alaska Fairbanks.
Females become pregnant during rutting season - in late summer and into the fall. These expectant mothers retain their antlers until calves are birthed in the spring. This allows them to protect food resources through harsh weather and to have enough for developing fetuses, he said.
So that would mean long hours of backbreaking work for an expecting Rudolph, as well as Donner, Blitzen, Cupid, Dasher, Dancer, Prancer, Comet, and Vixen.
"You don't hook up your pregnant females to a sled," Finstad said. "That is not good animal husbandry."
Non-expectant females finish shedding their antlers in February and March, along with young steers - castrated males. Bulls generally lose theirs before Christmas.
So, steers and non-expectant females also could be Santa's sleigh helpers, Finstad said.
Real-life sledders most often use steers because they maintain their body condition throughout the winter, he said. Bulls are tuckered out from rutting season when they mate with as many as a dozen females in months leading up to December. That leaves them depleted and too lean to pull a sleigh or sled through heavy snows, Finstad said.
Other aspects of the Christmas story support the all-girl sleigh team theory as well, said Blue-McLendon, whose school will put out a lighthearted news release this week suggesting the animals were female.
For example, would a boy reindeer really sport a shiny red nose that almost glows?
"Females like accessories," said Blue-McLendon, who in 2003 led the school's cloning of a white-tailed deer. "I think that fits because females like bling. We like shiny stuff."
As for the reindeer games, forget the rough antler-smashing stuff. Blue-McLendon suggests a female Rudolph would be more up for "games of wit."
And as for the name, Rudolph could certainly still work.
"Why not?" Blue-McLendon said. "I know women named Charlie."

Jury Duty Question
12-8-2008 Somewhere National:
QUESTION:
I have been called to jury duty. I am fine with this; however, the Juror Manager must be aware of an a priori conviction that I possess. This is that, I shall, without fail, irrevocably side with the defense in any legal dispute to which I am asked to be a co-quaesitor. This decision is based on several factors, the primary being moral, but also religious and historical (both personally but also legal history apart from myself).
I am not here to discuss the rightness / wrongness / rationality / etc. of this conviction, but to ask if this conviction is a basis for the contempt of court ad baculum lever applied by the legal system today? That is, shall I tuck my chin and prepare myself for a legal blow?
ANSWER:
Probably not. If you are genuinely biased, you should not get into trouble for saying so. If anything, keeping quiet about this is what could bring consequences.
The "juror manager", however, is unlikely to be the person you need to talk to. (I confess that I'm unfamiliar with the ____ court system; you may know something in this regard that I don't.) There are certain factors -- such as being a non-citizen -- that automatically disqualify potential jurors; administrative staff may be authorized to remove a potential juror from the pool if one of those factors disqualifies him or her. Otherwise, it will be up to the judge and the lawyers to decide whether you should serve. The answer may seem like a foregone conclusion, but that doesn't mean a clerk will be able to let you out of jury duty.

Dating someone under age

QUESTION:
If im 19 and i want to date someone who is 14, is that okay? If its just dating and no sexual activities.
ANSWER:
It is not illegal to do what you say, but it is a horrible idea with potentially grave legal consequences to you. Your best advice is to date someone your own age, at least over the age of 18 years. If you are accused and convicted of any type of sexual contact or activity, you stand the risk of doing 18+ years in the penitentiary. No girlfriend is worth that risk.

Sexual abuse to 6 yr. old
11-22-2008 Somewhere National:
QUESTION:
What does it take for the law to press charges for sexual abuse? My 6 yr. old son said his dad makes him put his mouth on his private. So of course there will be no physical evidence. So now what happens? How can I keep him away from my kids?
ANSWER-1:
Get up, walk straight to the telephone, call the police, the County Solicitor, and DSS.
ANSWER-2:
I would add: take your son to a doctor, IMMEDIATELY. Tell him your suspicions and ask for a full exam. Do this AFTER you have contacted the police because if the doctor sees signs of abuse, he's required to inform law enforcement. I think it's best if you do it first.

QUESTION:
I meet other people thru on-line personal ads. The sites I use require that you self-certify that you are 18 or older to enter. After I meet someone, I am amazed at the kinds of photos they send me - they actually photograph their genitals and send them to a stranger they have just chatted with via e-mail. I open the e-mail and there are the photos - completely unexpected. Assuming they did not lie about their age when posting their ad on the website, have I done anything wrong when these kinds of pictures show up in my e-mail? I do not request pictures like that.
ANSWER:
Why do you assume people aren't lying about their ages? On the Internet it is said that men are men, women are men, and children are FBI agents.
Woe betide you if you get busted with child porn on your machine, you'll be dragged away in handcuffs and you'll still be whining about how you didn't know as your cell door clangs shut.

QUESTION: Signed Confidentiality Agreement
If you signed a confidentiality agreement as a data recovery computer tech and found info on someones hard drive alluding to a serious crime are you leagally bound by the confidentiality agreement to not report it?
ANSWER:
You MUST report the crime if it involves child abuse (including child porn) or abuse of the elderly. It's a crime not to report child abuse or elder abuse. Confidentiality agreements cannot prevent you from reporting criminal activity, so you are free to report it, if you desire. If the criminal activity is ongoing, you could be charged in rare circumstances as an accessory if you don't report it.

QUESTION: My Computer was used to download illegal porn..
My computer is located in my place of business. At my business I allowed many people to use it for sending emails and some customers to download music and games from Limewire. I don't know a lot about computers and I had no idea that someone or some people would download this type of garbage on my computer. The FBI came by and wanted to check my computer so I allowed them to do that. They told me that they had a report from somewhere that illegal porn was downloaded on my computer. When they looked at the computer there as all kinds of porn and illegal photos somewhere in the computer. I had no idea, and If I had known how or saw it I would have deleted that garbage. The FBI picked up my computer and said they would have to keep it for evidence. Now what can I do?
I do know the names of all those people. I only know that most of them were my customers and a lot of them were young students from the local high school wanting to down music. If I had known I would never had let them use my computer. I operate a Barber Shop and a locale newspaper here in my business.
ANSWER:
Lawyer-1: You will need an experienced criminal defense attorney immediately. Even though you may not have accessed those images and/or may not have known they were even on your computer, the State and/or Federal government can still charge you with possession of illegal pornographic material, which is a very serious charge with life-altering consequences.
My firm does handle cases such as this; however, it is based in the Tampa Bay area. I do have a good friend who is an excellent criminal trial attorney in the Jacksonville area and would be more than happy to set up an introduction. He would definitely be able to assist you with this type of case.
If you are interested in his services, please contact my law firm and I can answer any questions that you may have.
Lawyer-2: It's not illegal to have some types of porn on your computer. However, other types of porn, such as child porn, carry serious consequences, usually prison time.
Also, it isn't a crime to have less than $2500 worth of unlicensed movies, music, or software on your computer, though you could be sued for it.
You need an attorney immediately. If nothing else, your story is suspicious. Why would a member of an anti-porn group allow high-schoolers free access to his computer without installing anti-porn software or checking the computer often to be sure it's free of illegal material?
It looks more like you were using the porn on your computer to ATTRACT teenagers.
