Revenge Porn Could Land Teens on Sex Offender Registry

GREENSBORO, NC – Ask a room full of people about revenge porn and they may have an inkling of what the law says. Ask a room full of teenagers and they may not know anything about it.

WHAT IS REVENGE PORN?

In short, the General Assembly passed a “revenge porn” law which took effect in December of 2015. The law bans someone from sharing nude photos or videos of a person without their consent to coerce, harass, intimidate, humiliate or call financial loss to the victim. If the person is over 18, they’re charged with a felony. If the person is under 18, they could be charged with a misdemeanor the first time, but a felony for any repeat offenses.

Detective Patricia Wright, with Greensboro Police’s Special Victims Unit said the cases they see most often deal with exes.

“Boyfriends and girlfriends that have broken up and now there is a new boyfriend or girlfriend who goes through their phone and they find this video which makes them very mad and they post these images online to embarrass the other person, “explained Wright.

But, more and more, detectives are seeing teenagers getting into the act of posting revenge porn. One example includes friends taking videos or pictures without the other person’s consent and then posting them when they get into an argument.

“This is one of the more preventable crimes that we come across,” Wright said. “The police departments across the nation are inundated with these types of cases.”

REVENGE PORN VERSUS CHILD PORNOGRAPHY

Teenagers as young as 12 or 13 can be charged with revenge porn.

“Once they hit the magic age of 16, we start charging as adults. And what children don’t seem to realize is, once you are charged as an adult, this carries with you for the rest of your life.”

Wright said what might shock most teenagers is sharing sexually explicit images or videos or another teenager or child under the age of 18 falls into another criminal category.

“Any time you are producing and disseminating children under the age of 18, that is the production and dissemination of child pornography when they are exposed in sexually explicit manner,” Wright explained. “That would make it a felony and potentially put you on the list as a sex offender.”

College applications, future job prospects and even places to live could be affected by a child pornography conviction.

ONCE IT'S ON THE INTERNET- IT'S FOREVER

Wright said often times, teenagers use apps like Snapchat, which deletes a picture or video after a certain number of views or 24 hours, whichever comes first. But, the detective warns people to remember, once something is online, it’s forever.

“They’re not gone. They’re just gone from where you can see them,” said Wright. “We have very good rapport with these social media sites. Through court orders, we can get that information back even through Snapchat.”

Posting a video or picture under an anonymous name won’t help keep you safe either. Wright gave the example of a recent case in Guilford County, where fake Instagram accounts popped up, containing nude images of underage female students at local high schools.

The accounts had interesting profile names.

“336 Hoes, 901 Hoes, Eastern Hoes or Western Hoes, whatever school they were affiliated with or whatever area code they were affiliated with.”

With the help of the State Bureau of Investigation, the creators of the accounts were found, even though they used fake names and fake emails to register the accounts. The suspects, whose names were not released, were charged with the distribution of child pornography.

Wright also warned even though a picture is deleted, someone may have taken a screenshot.

“A year or two years from now it could show back up.”

CAN YOU PREVENT TEENAGERS FROM POSTING?

It can be a daunting task to keep track of what teenagers are doing on their phones. But, Wright said, it’s a necessity to keep them from ending up on the wrong side of the law.

“We can’t expect that we can put this in children’s hands and always expect for them to make the right decisions,” said Wright, who often gives presentations at high schools on online safety.

She said the first thing she hears from parents once their child is a victim or charged with a crime related to pornographic images, is ‘I had no idea.’

“Parents are typically unaware of what their children are doing online. They’re locked out of their children’s phones because they don’t know their passwords. They don’t know what apps their children are using or how those apps work.”

Wright encourages parents to check their child’s phone, learn about the apps they use and teach them about the harsh realities they could face if charged with a crime. ..Source..

Maine sex offender run over after alleged assault attempt, police say

3-31-15 Maine:

Police report that James Oliver, 48, of Hampden, suffered a serious leg injury after his girlfriend ran him over with a car when she allegedly caught him attempting to assault a 12-year-old.

Police say that a convicted sex offender is recovering from injuries Tuesday after his girlfriend ran him over with a car when she caught him trying to sexually assault a 12-year-old relative.

Lincoln County deputies were called to a home on East Neck Road in Nobleboro at 11:30 p.m. Saturday for a domestic disturbance. When they arrived, they found James Oliver, 48 of Hampden, lying in the driveway after being hit and run over by a car.

A fight had broken out between Linda Currier, 53, of Hampden, and Oliver, her boyfriend, after she walked in on him trying to have sex with the 12-year-old girl.

Both Currier and Oliver had been drinking, police said.

Currier was charged with driving drunk and aggravated assault. She was taken to Two Bridges Regional Jail and later released on bail pending a court appearance.

Oliver was taken to Miles Memorial Hospital in Damariscotta and then to Maine Medical Center for treatment of a serious leg injury.

He was arrested Tuesday after his release from the hospital on charges of attempted gross sexual assault, unlawful sexual touching and failing to comply with the sex offender registration act because he did not provide a current address. He was then taken to the Maine State Prison infirmary in Warren pending a court appearance.

5 students arrested for beating up boy who reported sex act at school, officials say

3-16-15 Florida:

MDCPS says two students engaged in consensual sex act at Allapattah Middle School

MIAMI - Five students at Allapattah Middle School are facing charges after beating up a student who reported two others engaging in a sexual act at school, Miami-Dade County Public Schools spokeswoman Daisy Gonzalez-Diego said.

"Our school district has zero tolerance for inappropriate behavior of any kind, and we commend the student who came forward to report the incident," Gonzalez-Diego said.

Local 10 News investigative reporter John Turchin said a 14-year-old girl and 14-year-old boy were engaged in consensual oral sex in a school bathroom on Friday. He said the boy involved and his group of friends attacked the student who witnessed the act for snitching.

Local 10 News spoke to several parents on Monday who said they were outraged that school administrators never informed them of the incident.

"They better not be having any kind of sex in school," said parent Orlando Hernandez. "I don't understand that. They never told us nothing about that."

Gonzalez-Diego told Local 10 News that the students who assaulted the boy who reported the incident have been suspended with a recommendation for expulsion.

The five students have been charged with aggravated battery. School officials said they are still searching for one other student involved.

Deputies: Wimauma man beaten after making 'inappropriate sexual comments'

8-12-2014 Florida:

WIMAUMA -- A Wimauma man was arrested after deputies said he beat up a man who made "inappropriate sexual comments" to his girlfriend.

Erin Robinson, 19, is facing charges of attempted first-degree murder in connection with the beating, which happened Monday.

According to the Hillsborough County Sheriff's Office, Raul Ortiz, 58, and the girlfriend were at a store, and Ortiz was looking down her shirt and making inappropriate sexual comments to her.

The woman then told Robinson and other family members what had happened. Deputies said she knew Ortiz because he had previously dated Robinson's father's girlfriend.

Later that day, Robinson, his girlfriend and two unidentified people went to Ortiz's home on 12th Street to confront him about his behavior. When they got to his house, Robinson and Ortiz began arguing, and Robinson punched Ortiz in the fact three times, detectives said.

Ortiz fell to the ground, and Robinson grabbed his head and slammed it several times against concrete landscaping rocks, detectives said.

Robinson then fled the scene and was later taken into custody by deputies. He has been booked into the Hillsborough County Jail.

Ortiz was "severely injured" in the altercation. He was taken to South Bay Hospital, then later to Blake Hospital in Brandon. ..Source.. by BayNews9.com

Waterloo man sent to prison for shooting

10-13-2011 Iowa:

WATERLOO, Iowa --- A Waterloo man has been sentenced to prison for shooting and wounding a man who was making fun of him for being a registered sex offender.

Brandon Nicholas Lanier, 29, also was sentenced Friday for possession of crack cocaine with intent to deliver in connection with a bag of crack that police found while investigating the June 4 shooting.

He was sentenced to 10 years for intimidation with a weapon, five years for being a felon in possession of a firearm and 25 years in prison for the drug charge. The sentences will run concurrently.

His probation for the prior sex offense also was revoked.

According to court records, witnesses told police that the victim, 40-year-old Tony Flowers, was making fun of Lanier because he was listed on the state sex offender registry for having contact with a teenager.

Lanier's brother became upset with Flowers, and a fight followed. Flowers left but then returned, and a second fight broke out, records state.

When that scuffle was over, Lanier walked up to Flowers and pointed a handgun at this head, records state. The brother then came between the two, and Flowers drove off. Lanier opened fire, records state, and one of the bullets struck Flowers in the arm.

Officers who responded to the shooting noticed Lanier, who was on probation at the time for the sex charge, placing something by the steps of his house. They looked and found a zippered pouch with $500 in cash and crack cocaine, records state. ..Source.. by Jeff Reinitz

Suspect: "I shot him in the head"

3-8-2011 Washington:

SPOKANE -- A Spokane man is on life support after being shot in the head after a party over the weekend and court documents show the suspect confessed to the crime.

Investigators have arrested the suspect and have him on a $750,000 bail. Court documents show Robert Startin, 27, confessed to shooting Shane Reilly, 26, in the head.

Investigators said the shooting happened shortly before 4 a.m. Saturday on Sixth and Sunderland. Police responded to a 911 call of an accident to find Reilly injured and bleeding heavily in his truck. He was taken to a hospital where doctors found a bullet hole behind his ear.

Before the shooting, court documents revealed that Startin joined a party at the 600 block of South Woodruff. He did not know any of the people there but one person told him the "big guy" was a child molester. This made Startin mad because Startin said he has a relative who was molested. According to the Spokane County Sex Offender website, Shane Reilly is not listed as a sex offender.

Startin then told people he was going to his apartment to get some booze but instead got his stainless steel .45 caliber Springfield Armory model 1911. Startin said he loaded it, put it in a brown leather holster and took it back to the party.

A short time after rejoining the party, court documents revealed the "big guy" asked Startin if he wanted to go for a ride in his 1962 pickup truck. They drove around the area and then past the party. Shortly after they passed the party, Startin said he pulled out his pistol and shot the "big guy" in the head. The pickup drifted over and crashed into a trailer. Startin said he jumped out, went to his apartment, unloaded his gun, put it in its case and shoved it under his bed.

Shane Reilly's family told KREM 2 News Monday that he will never be off life support.

After learning of the bullet wound in Reilly, patrol officers set up surveillance on Startin's home and detained him when he left about 10:15 a.m. Saturday. He volunteered to accompany detectives to the Public Safety Building.

Detectives interviewed Startin and later booked him into the Spokane County Jail on a first-degree assault charge. ..SOurce.. by KREM.com

Victim of alleged sexual assault bludgeons suspect with frying pan

2-2-2011 Nebraska:


In Lincoln, Nebraska, a suspected rapist was attacked by a victim with a frying pan, leading the suspect to end up in a hospital for treatment.

According to Lincoln police, the incident occurred early Monday, following a get-together at an apartment, located in the 3100 block of North Hill Road.

Police say it happened when a 20-year-old woman was spending time with family members and friends at the apartment. After several hours of consuming alcohol, everyone fell asleep.

Police say that as the victim was sleeping on the living room floor, one of the get-together guests (a male) began to touch her improperly. In response, the victim constantly said “no” to the guest; however, that made the guest angrier, tearing her pants. She, then, kicked him away, and then took a frying pan out of the kitchen and hit him in the head with it four times.

The alleged assailant, identified only as a 23-year-old Lincoln man, was transported to the hospital early Monday morning to be treated for his wounds. According to CT scans, the man had sustained orbital and nose fractures. He is still in the hospital.

Sex offender pamphlets anger the sex offender

9-9-2010 Delaware:

A Kent County sex offender became angry when a 25 year old Maryland woman was distributing pamphlets about a neighborhood Tier 3 sex offender – 41 year old Gary Biron of Dover – when Biron confronted her. Biron threatened to kill the woman and punched her in the face while waving a wrench at her. The woman was able to get away and call for help. When State Police arrived at Biron’s home – he resisted arrest and hit one trooper with a chair. Biron is charged with numerous offenses and is free on $4000 secured bond.

Dover-Wednesday September 8, 2010 around 3:00 p.m. Delaware State Police responded to the unit block of Richard Blvd Dover, Delaware. Delaware State Police was initially responding to a disorderly complaint, which turned violent.

Delaware State Police contacted a 25 year old Maryland woman and learned she was confronted by Gary Biron-53 of Dover as she was distributing pamphlets regarding his Sex Offender status. The victim was leaving the pamphlets in Biron’s neighbors mailboxes. The pamphlets were from the State of Delaware Sex Offenders website which is a public website which everyone has access to. The pamphlet was a print out from the Sex Offender’s website displaying Biron’s status as a Tier III High Risk Sex Offender.

The altercation then escalated with Biron grabbing a pamphlet out of the victim’s
hand and threatening to kill the victim. Biron next punched the victim in the face
with his fist. Biron also is alleged to have been brandishing a wrench in his other
hand at the time of the physical altercation.

The victim attempted to call 911; however Biron took the victim’s cellular phone and threw it to the ground causing damage to it. The victim next was able to drive away from the scene at which time she dialed 911 for emergency assistance.

Troopers after obtaining the victims version of the complaint, then attempted to
make contact with Biron at his residence to place him under arrest. Troopers
contacted Biron at the front of his residence and attempted to take him into
custody. Biron turned and ran back into his residence with two Troopers giving
chase. As the 1st Trooper a 43 year old male; 12 year veteran attempted to take
Biron into custody, Biron swung and narrowly missed striking the Trooper. Biron
next picked up a wooden chair and began to swing it at the 1st Trooper and 2nd
Trooper a 49 year old male; 21 year veteran both out of Troop 3. The chair struck the 2nd Trooper on the arm and chest. The 2nd Trooper sustained a minor bruise however did not require medical treatment. The 2nd Trooper was then able to take the chair away from Biron and he was then placed in handcuffs.

Biron was taken to Delaware State Police Troop 3 Woodside and charged with the over listed offenses. Biron was released after posting $4,000 secured bond through a bail bonds company.

NOTE: The relationship between the victim and defendant is that Biron dates the victim’s mother. The victim was upset over an unknown altercation between Biron and her mother. ..Source.. by WGMD.com

Couple charged with attempted murder

9-5-2010 Oregon

A Philomath woman and Silverton man have been charged with attempted murder and other offenses, including kidnapping and beating an Alsea woman to keep her from reporting an alleged sexual assault on a child.

Peggy Tennessee Watkins, 35, of Philomath, and Bryan Eugene Dover, II, 32, of Silverton, have been charged with attempted murder, first-degree assault, four counts of first-degree kidnapping, two counts of second-degree assault, two counts of second-degree kidnapping and one count each of unlawful use of a weapon and third-degree assault.

Secret indictments against them were issued by a Benton County Grand Jury on Aug. 10. Both already were in jail for unrelated charges.

The two are accused of kidnapping Christina Sawyer, 31, from her home on May 4, driving her to a remote location and assaulting her with a tire iron and a handgun. According to an affidavit filed with the court, the events of May 4 unfolded like this:

Watkins drove to Sawyer’s Alsea residence and lured her into the car with the promise of getting money that Watkins owed Sawyer. Soon after she and Sawyer drove away, Watkins picked up Dover, who was waiting along the road. Sawyer, who believed Dover had sexually abused a 5-year-old girl related to her, asked Watkins to stop and let her out. Sawyer couldn’t get the door open, and Watkins kept driving, eventually traveling up a logging road.

After the car stopped, Dover told Sawyer he wasn’t a child molester. When Sawyer told him child molesters “act just like you,” Watkins struck Sawyer in the head several times with a tire iron, and Dover hit her on the head with a handgun.

As Sawyer was vomiting because of her head injuries, Dover and Watkins injected methamphetamine. They then told Sawyer they would take her to the hospital, but threatened to hurt her and her children if she “said anything” or contacted police. They picked up Sawyer’s boyfriend and dropped him and Sawyer off at the emergency room at Good Samaritan Regional Medical Center.

Sawyer, who later said she was frightened by the attack, initially explained to emergency room doctors that she’d fallen while trimming branches and had hit her head on a fence. She had numerous skull fractures and had to have surgery.

But a few weeks later, Sawyer told a doctor in Alsea that her story about falling into a fence wasn’t true. She reportedly told a Benton County sheriff’s deputy that she came forward because she wanted to report the sexual assault and because she was scared that Watkins and Dover were still “running around.”

But by then, Watkins and Dover already were jailed, having been arrested after a car chase in Salem. On May 18, they were spotted by a Salem police officer as they were driving a stolen Pontiac — the same vehicle, investigators believe, they were driving when they reportedly kidnapped Sawyer.

The officer tried to pull over the vehicle, but Watkins, who was driving, continued onto Interstate 5, driving south. Another officer tried to put a spike strip across the freeway to stop the car. Before he finished, he saw the Pontiac approaching and tripped. The officer said the car swerved toward him and never slowed, missing him by inches.

The vehicle was finally stopped when an officer intentionally hit it with a patrol car.

Watkins had been in Marion County Jail since that arrest. Dover had been lodged in Linn County Jail since May 20 on an unrelated parole and probation violation.

At Dover’s arraignment Wednesday, Deputy District Attorney Karen Stanley said Dover, a convicted sex offender, faced life in prison if arrested on new sex crime charges. She added that there is “grave concern” for Sawyer’s safety if Dover and Watkins are released.

Watkins and Dover are both scheduled for court appearances Thursday with court-appointed attorneys. They are both now in Benton County Jail. Watkins’ bail is $1,075,000; Dover’s is $1,675,000. ..Source.. Rachel Beck, Gazette-Times reporter

3rd Wisconsin woman cops plea for role in glue attack on ex-lover's penis

1-28-2010 Wisconsin:

Wendy Sewell has accepted a plea deal in a Wisconsin court over her role in helping to lure Donessa Davis to a motel room in Stockbridge, Wisc., and then gluing his penis to his abdomen.

The 44-year-old woman is one of three charged in the episode. She pleaded no contest to a charge of disorderly conduct -- a misdemeanor - on Friday. The two other women in the case , Michelle Belliveau and Therese Ziemann, reached similar deals last month. They will be all sentenced next month, WBAY-TV reported.

As we wrote in August, when the three women found out they were all being cheated on by Davis -- a married man -- they conspired to lure him to the motel room with the promise of a massage. Instead, they bound him up in a case of sticky revenge.

Pornographic text sparks tribal war

1-28-2010 New Guinea:

Two people are dead after a pornographic text message sparked tribal violence in Papua New Guinea's southern highlands.

The violence flared on Saturday when a young man from the Tapo clan in Tari sent a pornographic text message to a woman in the Pipi clan.

The girl was offended and showed the image to her brother, who gathered his clansmen and attacked the Tapos with home-made guns, bush knives and bows and arrows.

One man was killed in the clash and Superintendent Jimmy Onopia says another man was pulled from a bus and killed with an axe yesterday.

"Two people have died, several have been wounded, several houses have been burnt down," he said.

Woman denies paying for child molester's beating

1-5-2010 New Mexico:

CARLSBAD — A former Eddy County Detention Center employee faces a charge of criminal solicitation after allegedly attempting to pay an inmate to beat up another inmate: the man who was convicted of sexually molesting a 12-year-old relative of the employee.

Lisa Lloyd, 38, allegedly asked an acquaintance to deposit $100 in the account of Johnny Ray Brazeal, who allegedly battered Gary Tesch in jail after he was found guilty of criminal sex charges, an arrest warrant filed by the New Mexico State Police stated.

Detention center administration reportedly acquired a letter, apparently written by Brazeal after the alleged battery, requesting Lloyd to deposit the money in his account or he would tell his lawyer.

An internal investigation was conducted at the detention center and Lloyd was fired. ECDC acting Warden Shawn Funk reportedly declined to tell state investigators the details, saying they are personnel matters and therefore confidential, the warrant stated.

Tesch was found guilty in August of criminal sexual contact and criminal sexual penetration of a minor and sentenced to 18 years in prison. The charge stemmed from an incident in December of 2008 in which a 12-year-old girl said Tesch molested her in his recreational vehicle.

Brazeal pleaded not guilty to a count of aggravated battery for the alleged beating of Tesch in August.

Lloyd pleaded not guilty to the charge of criminal solicitation. She was placed on a secured bond of $5,000 and awaits a preliminary hearing at 10:30 a.m. Feb. 26 at Magistrate Court before Judge Henry Castaneda. ..Source.. Reid Wright, Current-Argus Staff Writer

NY- Jury: NY sex offender beat up wary neighbor

Secondary dissemination is a problem because rarely is it truthful. i.e., according to what the law allows. As such it gets into a new area of law libel and slander. Although we do not know what exactly what was posted (words) beyond a picture, all around people get upset and this is a likely result.

WATERLOO, N.Y. — A registered sex offender has been convicted of beating up a neighbor in a small-town apartment complex in upstate New York for posting fliers warning about his criminal past.

There is a major difference between "Warning someone" and "Informing someone." This is why it is best to refer folks to what the state posts, if doing anything at all.

William Meacham, his sister Stephanie and family friend Marvin Snyder were found guilty Thursday of gang assault on 35-year-old Adrian Porter, who was left with brain trauma, a broken nose and facial fractures.

They could get up to 25 years in prison at sentencing Dec. 21.

NY sex offender imprisoned for beating neighbor

WATERLOO, N.Y. (AP) - A registered sex offender has been sentenced to 14 years in prison for beating up a neighbor in central New York for posting fliers warning about his criminal past.

William Meacham, his sister Stephanie and family friend Marvin Snyder were found guilty of gang assault on 35-year-old Adrian Porter, who was left with brain trauma, a broken nose and facial fractures.

Authorities say Porter was confronted in an apartment complex parking lot in Seneca Falls in September 2008 after he posted the fliers showing state sex-offender registry photographs of Meacham.

Meacham, who's 32, served nearly four years for raping a 15-year-old girl in the Binghamton area. At sentencing Monday, his 25-year-old sister and Snyder both drew 13-year terms. ..Source.. by AP

Bashing pedophile a 'human, primal reaction'

A father accused of bashing a man who molested his son "reacted as any red-blooded father would", child rights campaigner Hetty Johnston says.

Ms Johnston, founder of child abuse support group Bravehearts, was speaking yesterday outside the Court of Appeal in Brisbane moments after Queensland's Attorney-General lost a bid to have Marsden man Shayne Thomas Davidson serve time in jail for molesting a 10-year-old boy.

In Beenleigh District Court three months ago Davidson, 42, pleaded guilty to indecent treatment of the boy after he molested him during a State of Origin party hosted by the boy's father at a home in Eagleby, south of Brisbane, in June last year.

The boy reported to his father what Davidson had done to him and the boy's father allegedly attacked Davidson so badly he was left with permanent brain damage, the court was told.

Consequently, a District Court Judge did not jail Davidson, saying the punishment already handed out and his injuries meant the case had "exceptional circumstances" and warranted a nine-month intensive corrections order aimed at his rehabilitation and supervision, not prison time.

The Attorney-General appealed the sentence but yesterday in a majority it was yesterday dismissed, with the Court of Appeal ruling Davidson received "the proper sentence".

After accompanying the boy's father - who cannot be identified and has not yet been found guilty of an alleged assault on Davidson - to hear the appeal decision today, Ms Johnston said she was upset the court had referred to the attack on Davidson as retribution.

"He didn't go away and think about this, he reacted I think as any red-blooded father would," she said.

"He reacted without thinking, he just reacted. He didn't go away and think 'this is how I'm going to get this guy back'."

She said the reaction the boy's father had was a "human, primal reaction".

"It's not vigilante, it's not retribution, it's not even thinking about that stuff. It's a parent's worst nightmare.

"I say every father when asked this question would say: 'I would kill anybody who touched my child'."

She said she was also concerned there was a lot of focus on the long-term effects on Davidson but not on the long-term effects his abuse would have on the child.

She said though she understood the Court of Appeal had acted according to the law, the community should decide if "this law that we have now, is what we want".

"Is this how we want these matters judged? Is this how the community feels about child sex offending? That's the bottom line," she said.

Dismissing the Attorney-General's appeal Justice Catherine Holmes ruled the sentencing judge was correct in finding there were "undoubtedly exceptional circumstances" in Davidson's case.

"Protection of the community did not loom large given this was (Davidson's) first offence," she said.

Justice Holmes said had it not been for the attack on Davidson and its "lifelong consequences", a term of nine months' jail would have been an appropriate punishment.

Justice Patrick Keenan said the concept of deterrence "works both ways".

"We also have to deter people taking the law into their own hands ... victims have to understand the law will take its course," he said.

The boy's father is expected to face court next year on a charge of grievous bodily harm.

FL- Man slapped with sex charge upon leaving hospital

8-27-2009 Florida:

WILDWOOD -- A 37-year-old man is facing charges of having sex with a minor as well as nursing head injuries, apparently after his roommate, the child's father, discovered the man having sex with his 16-year-old daughter.

Wildwood police said the father attacked the man with the butt of an unloaded shotgun last week shortly after arriving home and finding the man naked.

Police said after striking the man with the gun, the father pinned him down until police arrived. The 37-year-old was taken to Leesburg Regional Medical Center with injuries to the head. He was arrested Monday shortly after being discharged by officers who were waiting for him.

He is still in the Lake County jail Wednesday on $70,000 bail.

A jail official said Wednesday he would likely be taken to the Sumter County jail if he hasn't posted bond in two more days.

The Daily Commercial does not publish names or any information that would identify the victim of a sexual assault.

The incident occurred at the Stanley Street home of the 37-year-old man. The father and daughter lived with him, police said.

Police said when the father came into the home, he grabbed the first thing he saw -- the shotgun. Sgt. Russell Poitevent said the father knew the gun was unloaded and didn't try to shoot him, but did strike the man hard enough to send him to the hospital.

The father was taken into custody, questioned and released. Valentino added the 37-year-old signed a waiver stating he didn't want to file assault charges against the father.

SC- Parents Severely Beat Alleged Child Molester

Terry Gibbs, 54, Has Heart Attack After Beating

NEWBERRY COUNTY, S.C. -- A Newberry County man was severely beaten by the parents of three children who the man is accused of sexually molesting, and he was then dropped off at a detention center where he suffered a heart attack.

Officers said they saw the man, later identified as Terry Hugh Gibbs, 54, of Newberry, being put out of a vehicle at the Newberry County Detention Center on Sunday night. Gibbs told officers he had been beaten because he had sexually assaulted three children, all under 10 years old, to whom he is related.

The officers called an ambulance to the detention center. A short time later, Gibbs had a heart attack and was transported to a Columbia-area hospital for medical treatment

Newberry County sheriff's investigators learned that after one of the children told a relative about the alleged assault, the other children came forward. Gibbs was beaten by the parents of all three children.

Police said they have since learned a fourth child, also a relative of Gibbs, was also molested. Investigators said that there is no indication that any other children who were not related to Gibbs were molested.

Gibbs remains hospitalized. The Newberry County Sheriff's Office said that Gibbs will be charged with at least four counts of criminal sexual conduct with a minor and lewd act on child when he is released.

Investigators said "while they certainly empathize with the parents, it is important to discourage anyone from taking the law into their own hands."

No charges have yet been filed against the parents who committed the assault. SC- Man admits molesting grandkids, is beaten

8-12-2009 South Carolina:

COLUMBIA, S.C. A man was in an argument with his daughter in the parking lot of the Newberry County (S.C.) jail Sunday night — holding a blood-soaked towel to his ear — when a police officer asked him what happened.

“I molested my grandchildren,” the 54-year-old man said.

“What?” the officer, Jason Stuher, said.

“I’ve been molesting my grandchildren,” the man repeated.

Stuher told the man to sit on the ground until he could figure out what to do. Nearby, one of the man’s daughters was “hysterical and barely understandable,” according to Stuher’s report filed with the Newberry Police Department.

The man’s daughter told Stuher that her father had been molesting her daughter and her sister’s daughter. Sunday night, the man’s adult children confronted their father about the abuse, and he admitted it.

That’s when the man’s children started “whoopin’ up on him,” according to Newberry Police Chief Jackie Swindler.

The man escaped his children’s fury on foot but was picked up by one of his daughters, who drove him to the Newberry County jail.

But the man’s beating was the least of his worries. The stress from the situation was too much for his heart — which already has two stents — and he went into cardiac arrest, according to Newberry County Sheriff’s spokesman Maj. Todd Johnson.

Now the man is in a Columbia hospital recovering. Newberry County detectives are waiting for him to be released so they can charge him with molesting three of his grandchildren, each under the age of 10, and one additional child in the family. Investigators say the man will face charges of criminal sexual conduct with a minor and committing a lewd act on a child — charges that carry a combined maximum of 40 years in prison.

But the man’s children have not been charged with assault for beating their father.

Newberry County Sheriff Lee Foster said he is evaluating the case and will confer with 8th Circuit Solicitor Jerry Peace before deciding what, if any, charges to file.

“They gave street justice — certainly nothing in the law allows that,” Foster said. “As a parent, I can certainly understand somebody being upset. But as a law enforcement professional, they need to let law enforcement take care of the problem.”

Peace, whose jurisdiction includes Abbeville, Greenwood, Laurens and Newberry counties, declined to comment Tuesday afternoon because he has not reviewed the case.

The man has an arrest record that dates back to 1978 and includes arrests for driving under the influence, public intoxication, assault and battery, failure to pay cab fare, armed robbery, simple possession of marijuana and use of a vehicle without permission.

His arrest record does not include any sex crimes, and he is not a registered sex offender.

The man molested three of his grandchildren while he was baby-sitting, Johnson said. Investigators do not think the man molested anyone outside of his family.

The man’s children are cooperating with investigators, Foster said, but “they don’t have much to say about the beat down.”

A person who answered the phone at the man’s Newberry home said family members declined to comment.

Nearby Landlord Says It's Making Renting Property Impossible

JEFFERSON COUNTY, MISSOURI (KTVI-FOX2now.com) - A landlord and one of his neighbors in Jefferson County are squaring off over a sign the neighbor has put in his window.

The sign in the house next door reads "Registered Offender, JCSO," with the initials presumably referring to the Jefferson County Sheriff's Office.

The landlord says the sign is keeping families with children from renting his home, and, on top of that, he says it's misleading. There is no record of the man next door actually being on the sex offender list, or even having much of a criminal record.

IN- South Bend father charged in shooting of daughter's boyfriend

SOUTH BEND — A 61-year-old man accused of shooting at his daughter's boyfriend after catching him partially undressed in his home has been charged in the incident.

Michael Falls is facing two counts of criminal recklessness, Class D felonies, following the events that took place at his house in the 60100 block of Cedar Road.

Falls is accused of firing two shots at his 16-year-old daughter's boyfriend, one of which grazed the side of the man's head, according to past reports.

The father had reportedly heard the pair in a basement bathroom and later discovered the 20-year-old boyfriend hiding under a bathroom sink.

NC- Accused molester shot by girl's mother

6-24-2009 North Carolina:

LUMBERTON — A 43-year-old Lumberton man who was shot following accusations that he molested a 7-year-old relative has been charged with the sexual offense.

Ray Demery, of Trenton Drive, was apparently shot by the alleged victim’s mother, according to a sheriff’s report. The woman has not been charged with a crime. The Robesonian has elected not to identify her in order to protect her child’s identity.

Demery, who was arrested Tuesday evening, is charged with first-degree sexual offense. He was taken to the Robeson County jail and placed under a $120,000 bond.

Lt. Kathy Torre of the Robeson County Sheriff’s Office Juvenile Division said investigators served a warrant for Demery’s arrest shortly after his release from Southeastern Regional Medical Center, where he was treated for his injuries.

According to a sheriff’s report, Demery was with relatives in Pembroke on Friday night when a female relative asked him to stay with her daughter so that she could run an errand. According to a sheriff’s report, the woman received a phone call from her daughter, who said she had awakened and found Demery molesting her.

The report said the 7-year-old girl managed to lock Demery out of the house and waited for her mother to return. The woman told deputies that when she returned she confronted Demery and shot him.

A second sheriff’s report said that Demery reported being shot at about 3:10 a.m. Saturday. Demery told deputies that he was walking on Union Chapel Road when he “heard shots being fired” and “felt pain” in his arm and side. He also told deputies that he did not know who was responsible for the gunfire. He was then taken to the hospital.

Deputies began putting the pieces together when the 7-year-old girl was also taken to Southeastern Regional Medical Center and admitted as a victim of sexual assault.

Robeson sitter shot, charged with sex offense

Pembroke, N.C. — The Robeson County Sheriff's Office is investigating a case of a vigilante reaction to alleged child molestation.

Authorities said a woman shot Ray Demery Jr., 43, of Trenton Drive in Lumberton, after her daughter said he molested her.

A Pembroke woman told deputies she asked Demery to watch her 7-year-old daughter Saturday night.
